<p>The Marketplace operates as a platform connecting independent farmers directly with customers.</p><p>• The Marketplace does not grow, produce, store, or physically handle products.</p><p>• Farmers ship products directly to customers.</p><p>• Each transaction is between the buyer and the farmer.</p><p>The Marketplace facilitates listing, payment processing, and communication but is not the seller of record.</p>
<p>Users must:</p><p>• Be at least 18 years old</p><p>• Provide accurate information</p><p>• Maintain account security</p><p>Users are responsible for all activity under their accounts.</p>
<p>4. Products & Availability</p><p> </p><p>All products:</p><p>• Are produced and fulfilled by independent farmers</p><p>• May vary due to seasonality, weather, and harvest conditions</p><p>• Are subject to availability</p><p>Product descriptions and claims are provided by sellers.</p>
<p>When purchasing through the Marketplace:</p><p> </p><p>• You are purchasing directly from the farmer.</p><p>• Pricing is set by the seller.</p><p>• Taxes and shipping charges may apply.</p><p>• Orders are subject to seller acceptance and product availability.</p>
<p>Farmers agree to:</p><p> </p><p>• Accurately represent products and practices</p><p>• Comply with all federal, state, and local food regulations</p><p>• Package and ship products safely and promptly</p><p>• Maintain transparency regarding growing and harvesting methods</p><p>The Marketplace provides Farmer Cards and educational resources, but sellers remain fully responsible for operations and compliance.</p>
<p>• Payments are processed through third-party payment providers.</p><p> </p><p>• The Marketplace retains an 18% commission on completed sales.</p><p>• Remaining funds are distributed to sellers per payout schedule.</p><p>• Chargebacks or disputes may impact payouts.</p>
<p>• Farmers ship orders directly to customers.</p><p> </p><p>• Delivery times are estimates and may vary due to:</p><p>a. weather</p><p>b. harvest timing</p><p>c. carrier delays</p><p>Risk transfers upon shipment by the seller.</p><p>The Marketplace is not responsible for shipping delays caused by third-party carriers.</p>
<p>Customers must report issues within the stated window after delivery.</p><p> </p><p>Resolutions may include:</p><p>• replacement</p><p>• credit</p><p>• refund</p><p>The Marketplace may assist in mediation but final fulfillment responsibility remains with the seller.</p>
<p>Products sold through the Marketplace are:</p><p> </p><p>• perishable</p><p>• naturally variable</p><p>• produced by independent farms</p><p>The Marketplace does not inspect every farm or production process.</p><p>Customers acknowledge:</p><p>• potential allergens</p><p>• natural variations</p><p>• shelf-life limitations</p><p>• handling requirements after delivery</p><p>Sellers are solely responsible for regulatory compliance and food safety practices.</p>
<p>The Marketplace operates nationwide, beginning with regional farm participation and expanding over time.</p>
<p>Users may not:</p><p> </p><p>• commit fraud</p><p>• misrepresent products</p><p>• manipulate pricing or transactions</p><p>• interfere with platform operations</p><p>• resell products under false origin claims</p>
<p>All Marketplace content—including branding, layout, and materials—is owned by the Marketplace.</p><p> </p><p>Farmers retain rights to their own:</p><p>• product images</p><p>• farm descriptions</p><p>• stories</p><p>Users may not copy or distribute Marketplace content without permission.</p>
<p>To the fullest extent permitted by law, the Marketplace is not liable for:</p><p> </p><p>• product quality</p><p>• food safety issues</p><p>• allergic reactions</p><p>• shipping failures</p><p>• farmer conduct</p><p>• lost profits or business interruption</p><p>The Marketplace acts solely as a connection platform between buyers and sellers.</p>
<p>Users agree to defend and hold harmless the Marketplace from claims arising from:</p><p> </p><p>• misuse of the platform</p><p>• violation of these Terms</p><p>• seller product issues</p><p>• buyer misuse or handling of products</p>
<p>The Marketplace may suspend or terminate accounts for:</p><p> </p><p>• policy violations</p><p>• fraudulent activity</p><p>• unsafe food practices</p><p>• misuse of the platform</p>
<p>The Marketplace may update these Terms at any time. Continued use of the platform constitutes acceptance of revised Terms.</p>
<p>These Terms are governed by the laws of the State of Kansas, United States.</p>
